This Refund & Cancellation Policy ("Policy") governs all refunds, cancellations, and related matters for memberships and services provided by Soulmatch LLC, a California limited liability company in Santa Clara, California. Our Service is designed for serious, long-term matchmaking, requiring a minimum six (6)-month Membership Term to protect community quality and integrity.
This Policy complies with California's Dating Service Contracts Act (Cal. Civ. Code §§ 1694-1694.4), Automatic Renewal Law (Cal. Bus. & Prof. Code §§ 17600 et seq.), and consumer protection laws. It is incorporated into our Terms of Use and Membership Agreement. All fees are non-refundable except as expressly stated herein or required by law.
1. Membership Fees
Billing Structure: Fees are billed monthly on the 15th of each month, starting at enrollment, or as a single upfront payment if selected during enrollment.
Non-Refundable Fees: All payments toward the six-month term are non-refundable, subject to the Cooling-Off Period and exceptional circumstances below.
Payment Obligations: Early cancellation or non-use does not relieve you of the obligation to complete all six monthly payments. Unused features (e.g., introductions) may roll over but do not entitle refunds.
2. Cancellation Policy
6-Month Commitment: By enrolling, you agree to a contractual six-month term. This is a fixed-term agreement, not an auto-renewing subscription unless you opt in at term end.
Cooling-Off Period (California Residents): Under Cal. Civ. Code § 1694.1, California residents may cancel without penalty until midnight of the third business day after signing the Membership Agreement. Notify us in writing via email ([email protected]) or certified mail. Refunds will be issued within 10 days to your original payment method.
No Mid-Term Cancellation: After the Cooling-Off Period, memberships cannot be canceled, paused, or refunded mid-term. You remain liable for all fees.
Renewals: At the end of the term, memberships do not auto-renew. If you choose to renew, we will obtain affirmative consent and provide clear disclosures per California's Automatic Renewal Law. For renewals, you may cancel online or via the method used to enroll (e.g., "click to cancel" if signed up online).
Termination by Soulmatch: We may suspend or terminate for violations of Terms, Code of Conduct, or non-payment. No refunds or credits in such cases; you remain liable for outstanding fees.
3. Waitlist Deposits
Waitlist deposits (e.g., $499) are fully refundable if you are not selected for enrollment. If selected and you decline, the deposit is forfeited and non-refundable. Refunds process within 7-10 business days.
4. No Partial Refunds or Credits
We do not provide partial refunds or credits for:
-Partial months of service.
-Unused introductions, sessions, coaching, or features.
-Mid-term cancellations or pauses.
-Dissatisfaction with matches, outcomes, or Service (except under the 143-Day Promise, which extends service but does not refund).
5. Exceptional Circumstances
Refunds may be granted only in limited cases:
-Verified duplicate charges or overpayments.
-Technical errors in payment processing (e.g., system glitches causing incorrect billing).
-As required by law (e.g., if a contract is deemed void under Cal. Civ. Code § 1694.4 for non-compliance).
-We do not refund for "buyer's remorse" outside the Cooling-Off Period, changes in personal circumstances, or non-use.
6. How to Request a Refund or Cancellation
During Cooling-Off Period: Email [email protected] with "Cancellation Request" in the subject, including your name, email, enrollment date, and reason.
Other Requests: Contact [email protected] with your full name, email, payment details, and explanation. Provide supporting evidence (e.g., for duplicates).
Processing: If approved, refunds will be issued to your original payment method within 7-10 business days. We may deduct any applicable fees or costs.
7. Compliance with Laws
This Policy ensures easy cancellation where required (e.g., online for online sign-ups under "Click to Cancel" rules). For auto-renewing renewals, we provide annual reminders and simple cancellation options. Violations of law may entitle you to remedies, including refunds or contract voidance.
8. Binding Agreement
By enrolling, you agree to this Policy, the non-refundable nature of fees (post-Cooling-Off), and the six-month commitment.
